Unemployment

Unemployment Says I Have an Overpayment. Does It Matter Whether It Was a Mistake Versus Fraud?

Last reviewed 2026-07-08

Short answer

Yes, this distinction matters enormously, and the rules vary sharply by state. In Georgia, non fraud overpayments carry real waiver rights based on hardship, while fraud does not. In Texas, a fraud finding adds a 15 percent penalty, and the state states plainly it cannot forgive any overpayment, fraud or non fraud, for any reason.

What happened

An overpayment notice arrived. Is it labeled fraud or non fraud? This label can lead to very different results. This area of unemployment law varies a lot by state. What applies in one state can look completely different in another.

What usually applies

In Georgia, non fraud overpayments come with waiver rights. Fraud overpayments do not get this right. To get a waiver, you must show three things. The benefits were paid through no fault of your own. Repaying would cause real hardship. You have no real way to repay it. You must do this within 15 days of the overpayment decision. Texas works very differently. A fraud overpayment there adds a 15 percent penalty. Texas says it cannot forgive any overpayment at all. There is no hardship exception there. These two states show how different this can be. Confirm your own state's rule directly.

The overpayment was not established due to fraud (waiver rights are provided on the non-fraud overpayment determination).

What to do

  1. 1

Find out whether your notice classifies your case as fraud or non fraud

This label is usually stated right on the notice. It decides which rules and options apply to your case.

  2. 2

Ask your own state whether a waiver or hardship exception exists

Georgia and Texas show two different paths. Some states offer a real waiver. Others offer none at all. Ask directly. Do not assume.

  3. 3

Note any deadline for requesting a waiver or appeal

Waiver windows can be short. Some are as little as 15 days from the decision. Act quickly once you get the notice.

  4. 4

If you believe the fraud label is wrong, ask how to challenge that specific finding

A fraud label can add a penalty on top. Disputing this label matters. It can matter as much as disputing the amount itself.

When to get help

Fraud versus non fraud rules vary a lot by state. Contact your own state unemployment office quickly. Also contact a legal aid office. This label can carry serious money consequences. Getting the right answer for your own state matters.
